The Government of Mauritius has brought amendments to the regulations that allowed the spouse of a citizen of Mauritius to work in Mauritius without a work permit. The change was brought about by the Minister responsible for employment matters through the Non-Citizens (Employment Restriction) Amendments No. 1 and Amendment No. 2 Regulations 2019. As the law stands today, non-citizens being the spouse of a citizen of Mauritius is no longer exempted from the regulations and thus need to apply for Work and Occupation Permits.
Existing employees, who are spouses of citizens of Mauritius are exempted from the provisions of the Act, for a period of 3 months after the coming into operation of the regulations.
An Employer of a non-citizen, who is a spouse of a citizen of Mauritius who intends to continue to have non-citizens in his employment shall, within a period of 3 months, as from the 28th of March 2019, apply and obtain a permit in respect of the non-citizen under the Non-Citizens (Employment Restriction) (Work Permit) Regulations 2017.
We are also informed that the Minister is working on introducing a grandfather clause in the new regulations that would mean that all non-citizen spouses of a citizen of Mauritius who was in employment before the coming into operation of this new regulation will not require a work permit.
